If convicted, McGrath faces a maximum sentence of 20 years in federal prison for each of the four counts of wire fraud, and a maximum of 10 years for each of the two counts of embezzling funds. In the state case, misconduct in office carries a penalty only described by law as any sentence that is not cruel or unusual, while the wiretap and theft charges carry a maximum of five years each.
